Terms & Conditions

These Terms and Conditions govern the sale of food and snack products by Totally Tasty and Total Office, trading names of Thurgoods Limited (Company Number 00690535), with a registered address at 6 Carnival Park, Carnival Close, Basildon, Essex. These Terms apply to all orders placed via our online store as well as any orders placed directly with us through other means, including email, telephone, or in person. By placing an order with us, you agree to be bound by these Terms.

1. General

  • 1.1 These Terms apply to all sales of food and snack products by Totally Tasty and Total Office to corporate customers.
  • 1.2 We reserve the right to amend these Terms at any time, with changes taking effect upon publication on our website.

2. Quotations

  • 2.1 Our quotations remain valid for 28 days from the date of issue and are for the sole use of the addressee.
  • 2.2 Any modifications to a quotation must be confirmed by us in writing.

3. Catalogue & Brochures

  • 3.1 All descriptions and illustrations of goods in any catalogue, brochure, price list, website, or other document supplied by us are for general guidance only and do not form part of any contract between you and us.
  • 3.2 We accept no liability for any errors or omissions in such documents and cannot be held responsible for any loss or damage resulting from reliance on these descriptions and illustrations.

4. Products & Orders

  • 4.1 We supply packaged snacks and fresh/perishable items.
  • 4.2 Bulk discounts may be available upon approval.
  • 4.3 All orders are subject to availability, and we reserve the right to reject or cancel any order at our discretion.

5. Payment & Credit Accounts

  • 5.1 Customers may pay via credit card or apply for a credit account (subject to approval and credit checks).
  • 5.2 Credit account invoices must be settled within 30 days from the invoice date.
  • 5.3 Late payments will be subject to interest at 2% above the Bank of England base lending rate until full payment is received.
  • 5.4 We reserve the right to suspend or cancel accounts with overdue balances.

6. Retention of Title

  • 6.1 Notwithstanding delivery of the goods, we retain ownership of all goods until full payment has been received in accordance with this contract.
  • 6.2 The risk in the goods passes to the buyer upon delivery.

7. Delivery & Shipping

  • 7.1 We deliver to designated postcodes listed on our website. Nationwide delivery is available on a case-by-case basis upon approval.
  • 7.2 Our standard delivery timeframe is 3 working days, but this may vary due to unforeseen circumstances.
  • 7.3 Customers must ensure that delivery details are accurate. We are not responsible for delays or losses due to incorrect information.

8. Shortages, Damages, Discrepancies, and/or Loss in Transit

  • 8.1 We will, at our discretion, refund, replace, or issue credit where goods have been lost, damaged in transit, or there is a short supply of an order.
  • 8.2 We will only consider claims made within 3 days of the delivery date.
  • 8.3 If an entire consignment is lost, you must inform us within 3 days of the invoice date.

9. Returns & Refunds

  • 9.1 Return of Defective Goods
    • If a product is defective or damaged, we reserve the right to replace it rather than issue a refund.
    • Refunds will only be issued at our discretion; in which case a credit will be applied to the customer’s account.
    • If a replacement is offered, you must accept it unless clear cause for refusal is provided.
    • All defective products must be returned to us before a replacement is issued.
  • 9.2 Returns of Unwanted Items
    • All returns of unwanted items are subject to our approval and must be requested within 5 days of delivery.
    • Goods must be unused, unopened, and in their original packaging.
    • If a return is approved, the customer is responsible for any return shipping costs unless otherwise agreed.
    • We reserve the right to decline returns for perishable goods unless they are defective or damaged upon delivery.

10. Allergen Disclaimer

  • "Our products may contain or come into contact with allergens, including but not limited to nuts, dairy, gluten, soy, and other common allergens. It is the customer’s responsibility to review product ingredients before consumption or resale. Totally Tasty and Thurgoods Limited accept no liability for allergic reactions or adverse effects caused by our products. If you have specific dietary requirements or concerns, please contact us before purchase."

11. Resale of Products

  • 11.1 Customers are permitted to resell our products unless otherwise stated.
  • 11.2 We do not guarantee the condition or shelf life of products once they have been resold.

12. Liability

  • 12.1 We shall not be liable for any indirect, incidental, or consequential losses, including loss of profits, arising from the use of our products.
  • 12.2 Our liability for defective products shall be limited to the replacement of goods or refund (as determined under Clause 9).

13. Force Majeure

  • 13.1 We reserve the right to cancel an order, suspend, or delay delivery without liability if supply of goods is prevented or delayed due to:
    • War (declared or not)
    • Civil strife, riots, or labour disputes
    • Adverse weather conditions, fire, or flood
    • Accidents or other circumstances beyond our control

14. Dispute Resolution

  • "These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall first be attempted to be resolved amicably through negotiation. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales."
